TERMS & CONDITIONS
THE CLIENT
1. We retain the Studio as the sole photographer to perform professional photographic service as detailed. To avoid disruption to your photographic coverage and to allow the Studio to fulfill its contracted duty, other photography by family and friends will be at the discretion of the Studio’s photographer.

2. We agree that payment of the initial deposit/booking fee confirms the booking with the Studio as per details shown on this contract.

3. We have received, read and understand the Studio’s price list which has been confirmed for our wedding on payment of the deposit/booking fee.

4. We agree to pay any further payments as required at least four weeks prior to the Wedding Day. Failure to do so gives the Studio the right to refuse to carry out the requested photographic services. Furthermore, the initial deposit/booking fee will be forfeited.

5. We authorize the Studio to arrange the photography of our Wedding in accordance with details shown on this contract. We are satisfied that the details are correct. If the photographer is required to remain after the meal, a meal will be provided by us.

6. We agree to advise the hairdressers and make-up artists, the hire cars and caterers of all the relevant times, details and locations as detailed here and to co-ordinate their services.

7. The details and times listed on this contract form part of this agreement and we agree to make every effort to co-operate in order for the Studio to fulfill its contracted duty. We acknowledge the Studio cannot accept responsibility for the extent of the photographic coverage if these terms are not met.

8. We accept the responsibility to contact the Studio, at least four weeks prior to the wedding, to confirm the details are correct and there are no alterations.

9. We agree to immediately advise the Studio in writing of any alterations in the details listed here including postponement or cancellation of the wedding.

10. In the event of cancellation of the wedding we agree that the deposit/booking fee will be forfeited. However, the Studio reserves the right to allow the person or persons who lodged deposit to claim a credit towards their wedding photography within twelve (12) months of the date of the contract. The onus is on the person claiming the credit to prove they are the owner of the deposit.

11. The booking of and any additional costs incurred for booking venues, photography locations, car parking etc., are our responsibility.

12. We assign the copyright in all photographs to the Studio and hereby give permission to the Studio to use any images of our wedding for advertising, publicity, general promotion, competitions, exhibitions and any other purposes thought proper by the Studio.

13. It is understood that these photographs are only to be used as agreed and may not be copied or reproduced unless written approval has been granted by the Studio.

14. The negatives/digital files remain the property of the Studio and will be kept on file for a period of five years. We recognize that materials and technology change constantly so we need to place our required order as soon as possible to obtain the optimum quality. We also accept that charges for our orders will be at the current prices applying at the time when the order is placed.

15. Should the nominated photographer not be available for any reason, the Studio will notify the Client of the change as soon as it is known and provide another photographer or provide a refund, whichever is the Client’s choice.

16. We also understand that:

(a) All orders including family and friends’ orders are to be placed within 12 weeks of the wedding date, otherwise prices current at the time of ordering will apply.

(b) The wedding will be considered one order, regardless of how many individual parties request photographs. We will be responsible for the entire order and no partial orders will be given out until the balance is paid.

(c) All orders must be accompanied by full payment unless prior arrangement with the Studio has been made.

(d) Should there be a balance when collecting the photography order we agree to pay and collect within seven (7) days of notification of completion, if we fail to do so then the order shall be in default and the Studio shall charge a default charge of 2% per month (20% annual rate) on the unpaid balance (minimum monthly charge of $5.00). In addition, we acknowledge that no further orders will be processed until the order is paid in full.

(e) The goods supplied by the Studio shall remain the property of the Studio until full payment has been made.

(f) Telephone orders require written confirmation with payment before the order can be produced.

(g) All freight and postage which we request will be paid by us.

(h) The Studio has no control over the environment in which the photographs are kept and that colour photographs in common with all sensitized materials and colour dyes, have a limited life expectancy when exposed to strong and prolonged sunlight or fluorescent light sources. Photographs will retain their colour and brilliance much longer when displayed under more desirable lighting conditions.

THE STUDIO
1. As the photographs made by the Studio are manufactured with the finest materials currently available, the Studio unconditionally guarantees them. If in your opinion any photograph made by the Studio has lost its original colour, the Studio will replace the photograph for fifty per cent of the then current selling price. The original photograph must be returned and the reprinting charge paid in advance. This warranty will be valid for as long as the Studio has in its possession the original negatives/digital files in a printable condition.

2. The Studio shall carry out this assignment with due and professional diligence however there are elements beyond the Studio’s control including faulty material, equipment failure, damaged and exposed film, damaged and loss of film/photos/negatives/digital files in transit between the Studio and laboratories employed by the Studio, loss or damage to film, negatives/digital files and proofs during processing and developing, either by the Studio or laboratories employed by the Studio, industrial disputes, civil disturbances or weather conditions which may inhibit or prevent the Studio from completing in whole or in part and the Studio shall not be liable for the complete performance of the assignment and it is agreed that the liability of the Studio shall be limited to a proportionate refund of any money paid under this agreement which shall be in full and the final satisfaction of any damage or loss suffered by us.
